Fennell Challenges Amount He Is Ordered To Pay In Court Of Appeals

CHICAGO, Ill – Oral arguments were heard Wednesday in the 7th Circuit Court of Appeals in Chicago in the case of 50 year old Franklin Fennell.

Fennell’s attorney argued the $110,600 restitution that Fennell has been ordered to pay was more than the $80,500 that he received and was outlined in the original 12-count indictment.

Fennell, is serving a 24-month sentence at the federal penitentiary in Marion, Illinois, for part in the crime.

As part of the scheme, a vendor submitted inflated invoices for work at school properties, and then he would split the proceeds of the scheme with Fennell and co-conspirator Frank Shahadey.

The federal appeals court judges have taken a restitution challenge under advisement. No word on when a decision might be reached.
