VCSC Asks For Summery Judgement Against One Defendant

TERRE HAUTE, Ind. – The Vigo County School Corporation has filed a motion for a Partial Summary Judgment in its case involving four people involved in a kickback scheme.

The civil lawsuit is against Frank Shahadey, Paula Shahadey, Franklin Fennell, and Michael Pick, and Pick’s business, M & P Properties, LLC.

A court can order a summary judgment when there is no dispute about the material facts in a case. The corporation says that trial transcripts show that Mike Pick admitted to his role in the conspiracy, that the entire scheme wouldn’t have been possible without him and that he should have reported the criminal scheme when Fennell and Shahadey asked him to join.

Pick has not been criminally charged for his involvement.

Shahadey admitted his guilt as part of a plea deal and has already served time in prison and is serving two years probation.

Fennell was found guilty by a jury and was sentence to 24 months in prison, but on Friday he appealed that conviction.
