TERRE HAUTE, Ind.  – According to online court records, The State of Indiana and Bethesda Gardens have come to an agreement.

Due to that consent decree, a court hearing set for tomorrow will not happen.

The state had filed for an injunction against Bethesda Gardens saying that they were offering care and services that they were not licensed for.

Bethesda Gardens got into trouble when it was discovered that they were operating a memory care which has since been closed.

Back on January 26th and resident that suffered from dementia wandered outside the facility and died of hypothermia.

An investigation showed that several door alarms and cameras to monitor and protect residents were not functioning properly.
