Decision On Primary Ballot Dispute Expected Soon

TERRE HAUTE, Ind – Attorneys for the county and a candidate for Terre Haute District 3 City council presented their final arguments Tuesday morning in court.

Candidate Tess Brooks-Stephens argues she should be listed before candidate Cheryl Loudermilk in alphabetical order.  She is currently listed using the letter S of her second last name and not B of her first last name.

Brooks-Stephens also says that any alterations on her filing form were not by her but someone in the clerks office.

On Monday a Tribune-Star article written by Dave Taylor was entered into evidence. That article quoted Newman as saying his office would change the order of candidates on the ballot if appropriate. Newman has since disputed making that statement and on Monday testified, he could not recall the details of his conversations with Taylor.

By 4 p.m. this afternoon, both attorneys must file with the court their suggested findings of fact and conclusions of law.

Judge Sarah Mullican is expected to issue an order very soon since the election is May 7th.

Chris Gambill the attorney representing Brooks-Stephens says that they are asking for new ballots to be printed and for those that have already cast ballots in early voting to be informed that they can recast their ballots.
